Starbase Adventures

1.Acceptance of these Terms

These Terms of Use govern your use of Starbase Adventures (the “App”), published by AgileConqueror. By downloading, installing, accessing or using the App, you agree to these Terms.

If you do not agree to them, do not use the App. These Terms apply to Starbase Adventures only; other AgileConqueror apps have their own.

2.Use of the App

The App is provided for your own lawful, personal, non-commercial use. You are responsible for the device you use it on, for your network connection, and for any costs your carrier or network provider charges you.

You agree not to misuse the App or use it in a way that breaks applicable law or interferes with anyone else’s use of it.

3.Licence

Subject to these Terms and to the rules of the store you downloaded from, AgileConqueror grants you a limited, non-exclusive, non-transferable, revocable licence to install and use one copy of the App on devices you own or control, for personal use.

This is a licence, not a sale. No ownership of the App, its code, its design or its content transfers to you. Any rights not expressly granted here are reserved.

4.Store terms

The App is distributed through the Apple App Store and Google Play. Your download, installation and any purchase are also subject to the terms and policies of the store you used, in addition to these Terms.

• On iOS: the Apple Media Services Terms and Conditions, including the Licensed Application End User Licence Agreement
• On Android: the Google Play Terms of Service

Where the store’s terms conflict with these Terms in relation to your download or purchase, the store’s terms govern that aspect.

5.In-app purchases

Starbase Adventures offers optional digital purchases. Purchases are made and billed through your Apple Account or Google account, and AgileConqueror never handles your payment details.

The App offers the following kinds of purchase:

• Consumable items — in-app currency and similar items that are used up as you play. Once used, consumables are generally not restorable.
• Non-consumable items — permanent unlocks tied to your store account, which can generally be restored on a device signed in to that account.
• Subscriptions — recurring access, described in the section below.

Digital items have no monetary value outside the App and cannot be exchanged for cash or transferred to another account.

6.Subscriptions

Starbase Adventures offers auto-renewing subscriptions. Prices, durations and what each tier includes are shown in the App and on its store listing before you confirm a purchase.

Payment is charged to your store account at confirmation of purchase. A subscription renews automatically at the end of each period unless auto-renew is turned off at least 24 hours before the period ends, and your account is charged for renewal within 24 hours of the end of the current period.

You can manage or cancel a subscription in your store account settings:

• iOS: Settings → your Apple Account → Subscriptions
• Android: Google Play → profile → Payments & subscriptions → Subscriptions

Cancelling stops the next renewal. Access normally continues until the end of the period you have already paid for.

7.Refunds

Purchases made through the Apple App Store and Google Play are refunded according to that store’s policies, not by AgileConqueror directly. Requests go through Apple’s “Report a Problem” process or the order history in Google Play.

Nothing here limits refund or cancellation rights you may have under consumer law in your country.

8.Intellectual property

The App’s software, source code, interface design, original artwork, original text and the AgileConqueror name and logo are protected by copyright, trade mark and other intellectual property laws. Except for the licence described above, no rights in them are granted to you.

You may not copy, modify, distribute, sell, lease or create derivative works from the App or any part of it, except where applicable law expressly permits it despite this restriction.

9.User conduct

When using Starbase Adventures, you agree not to:

• use the App for any unlawful purpose
• reverse engineer, decompile or disassemble the App, except to the extent applicable law expressly permits despite this restriction
• interfere with, disrupt or place undue load on the App or the services it uses
• attempt to gain unauthorised access to any part of the App, its data or its accounts
• circumvent purchase, entitlement or security mechanisms

10.Availability and changes to the App

AgileConqueror may add, change, suspend or discontinue features of Starbase Adventures at any time, and may stop distributing or supporting the App entirely. Updates may be required for the App to keep working with current operating systems and store requirements.

The App is not guaranteed to be available without interruption, and no permanent availability of any specific feature is promised. Where a feature you have paid for is discontinued, your rights under consumer law and the refund policies of the Apple App Store and Google Play continue to apply.

11.Third-party services

Some functionality depends on services operated by other companies, each with its own terms:

• Apple — distribution, updates and payment processing
• Google — distribution, updates and payment processing

AgileConqueror does not control those services and is not responsible for their availability or their content.

12.Disclaimer

To the extent permitted by applicable law, Starbase Adventures is provided on an “as is” and “as available” basis. AgileConqueror does not warrant that the App will be uninterrupted, error free, or that it will meet any particular requirement.

Some jurisdictions do not allow certain warranties to be excluded. Where that is the case, the exclusions above do not apply to you, and you keep the statutory rights your local law provides.

13.Limitation of liability

To the maximum extent permitted by applicable law, AgileConqueror shall not be liable for indirect, incidental, special or consequential losses arising out of your use of, or inability to use, Starbase Adventures.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, for fraud, or under mandatory consumer protection law.

14.Changes to these Terms

These Terms may be updated as Starbase Adventures changes. When they are, the effective and last-updated dates at the top of this page are revised, and the current version always remains available at this address. Continuing to use the App after an update means you accept the revised Terms.
